Pension Surplus Update: Bargaining Agents Determined to Win Pension Appeal Case
OTTAWA – In 1999, eighteen federal bargaining agents, employee associations and retiree groups that together represent more than 300,000 federal public service employees undertook this legal challenge following passage of Bill C-78, the Public Sector Pension Investment Board Act. This Bill enabled the Federal Government to appropriate some $30.2 billion dollars from superannuation accounts of federal public service, RCMP and Canadian Forces employees.
In a communiqué to our members dated November 21, 2007, we informed you of Mr. Justice de Lotbinière Panet’s decision dismissing the court challenge on the federal public service pension surplus dispute. Following the review of this decision, ACFO met with legal counsel and the 17 other bargaining agents, employee associations and retiree groups, to discuss the next steps to be taken in this case. We are pleased to report that the bargaining agents agreed unanimously to appeal Mr. Justice deLotbinère Panet’s decision. The parties showed unequivocal determination in taking this legal challenge to the Court of Appeal for Ontario and if necessary, to appeal it to the highest court in the country, the Supreme Court of Canada.
